How can the government even legislate offshore drilling?

I thought that the borders only extended 12 miles out, whereas the drilling would take place over 25 miles offshore.

Because Oil Leases are needed to permit production of Oil Anywhere so the Companies have a legal right to extract.With out a lease it is theft.
