How can we get a US work permit for my british husband?

I'm American and have been living in the UK for 5 years (I have a Indefinite Leave to Remain visa through my bri husband). I've just moved back to the states (yesterday!) and am looking for work. My husband stayed in Scotland because we didn't think it would be wise for us to both come over jobless but we want him over here in the next few months. If I don't have a job secured, can my mother sponsor him, ie show proof of income for him to be able to come over and work or does it have to be me? I just know its a lengthy process so the sooner we can file the paperwork the better. Thanks!

  1. Until he has a visa of some kind, he'd be unable to come to the US and remain indefinitely, so it was a wise choice leaving him in Scotland.

    You need to get the ball rolling by petitioning for a visa number to be made available to him on the grounds of an immediate relative. See the link below for more information on this.

    Part of the process will be financial support for the intending immigrant. You will have to sign a binding agreement stating your intent to support your husband, and you must have an income above 125% of the Federal Poverty Level. If you are unable to meet this requirement, you can have other US citizens (they don't have to be related to you) co-sponsor the intending immigrant along with you. Even if you have to use someone else's income, you still must be the primary sponsor.


  2. IF you are married and have legal papers you could come to the USA and through an attorney get the papers you need.  He has a right to be here as your husband if everything has been done legally.

  3. You would have to petition for him yourself but your mother could act as a co sponsor if you don't make enough to support him initially. Go to http://www.visajourney.com where you will find free guides and forums full of people bringing foreign spouses and fiances to America. My husband and I used the information there and the help and advice of other members to file all our applications. A K-3 visa would be your most likely choice and while it might not get him here for Christmas it should be over by late winter, early spring.
