How can you get a divorce when the person you married is still married to someone else?

  1. It sounds like you were never legally married............


  2. If one person is already married, the second marriage is not legal.

  3. This is not as simple as some answers may suggest.  You marriage is invalid, but it is not enough to say that your marriage never counted.  Remember each state has their own marriage laws (meaning you could very well be married if your husbands previous marriage took place in another state).  In most states, you will be able to get an annulment.  In others you may have to go through the process of a divorce (even though your marriage is invalid!).  

    Bottom line: you need to consult an attorney for advice.  You need to know your options and know what you need to do to ensure that you are no longer "married" to this individual.  Don't do nothing and just assume it is invalid.  I know a woman in a similar individual that had to still get a divorce.
