  1. Cause they do.  People don't usually get caught for downloading.  They get caught for uploading/sharing.  When someone sends information out of their computer, it's like flagging yourself.  Which leads people to monitoring you, and they bust you for downloading.

  2. They do get busted for file sharing.  Uploaders get cited more frequently than downloaders, but downloaders have been sued.  The more files you "share" the more likely you are to catch the attention of the sorts of people who will sue you or have you prosecuted for copyright violations.

  3. People do. It's mostly the serious offenders and the ones making the files available for download that get busted.

Think of it like driving over the speed limit. It's illegal, right? But usually only the serious offenders get caught.

  4. They have been law suits filed against some people who were sharing 1000 songs, but it is mostly related to the publicity of getting busted and turns out to be a waste of time because more people learned they could find 1000s of songs this way and the record companies give up after the cost exceeded the purpose. Most of the cases are dismissed because none of the people sold songs and no money was recovered, so it came to a pointless bust for record companies since only lawyers got paid anything.
