How come people on here who admit they smoke marijuana aren't getting busted?

Like I've seen several questions from drug users who are asking advice on how to get a drug out of their system before a drug test. I've also seen people answering them with illegal advice. how come they aren't getting busted?

  1. You have no proof that the people are actually doing it.  They may only be questioning it. People could actually make up these questions.  For someone to get busted there has to be proof that they actually did the crime they are asking about. Everything you are reading is Heresay.  Then you would have to try and find out who people are.  There are fake names, ages, states, etc.


  2. because no one polices the internet. if the government really cared what was on the internet it would be as censored as our television is.

    by the way you can walk up to a cop and tell him that you smoke pot and they cant do anything. they have to have proof like weed or a pipe full of resin to have a case in court.

  4. For one, they would be hard to track down. Also, the evidence probably wouldn't be admissible in court, and the 5th Amendment states that people cannot incriminate themseleves without being read their rights, so it would be unconstitutional to arrest someone based on this.

  5. Here is what it would take to get busted from a post on this site about committing a crime.

    First, someone from a police agency would have to be monitoring these questions and answers -- something that really is not a productive use of time.

    Second, that police agency would have to request a subpoena to yahoo for the information behind a handle which might require a further subpoena to an isp.

    Now if lightning strikes those subpoenas might reveal a name within that agencies jurisdiction.  (However, even the NYPD and the LAPD have less than a 5% chance of getting a local person).

    Third, you then have to get evidence that the person with that handle was the actual poster (as opposed to a friend playing a joke or a hacker).

    Fourth, even if you did have a valid admission, you still do not have a case.  While the Fifth Amendment's right to not incriminate does not apply (since nobody forced the person to ask or answer the question on Yahoo and the person was not in custody), the due process clause still applies.  One of the elements of the due process clause is a doctrine typically called the corpus delecti rule.  The corpus delecti rule says that you need something besides a confession to convict someone of a crime, you need evidence that there was actually a crime.  In other words, you need to find and recover the drugs in question.

    In short, people claiming to be drug dealers on yahoo are probably idiots because they just might get themselves popping up on a list to be looked at more closely.  However, police need that additional step of finding them in actual possession of a drug (or with drug metabolites in their system) before they can be charged.

    p.s.  While the offense is technically possession, you can't use without actually possessing.  Thus, proof of consumption (e.g. positive UA) combined with an admission that you knew that it was drugs that you were using would be enough to prove possession.

  7. If they busted everyone who used pot, your head would explode at how popular it is.  Get this:  even cops smoke it.

    The drug laws are medieval and no one should get busted for getting high.

  8. Because Y!A won't give out their information to the Police without a subpoena, and it is too costly for local Police to pursue for someone saying that they use or possess drugs.

    Now if the person stated that they had a truckload of marijuana to unload, I think that the FBI and the DEA might be interested in researching their IP address and following up on it.

  12. It isn't illegal to say you use it...and to be honest, law enforcement isn't that worried about someone smoking a joint.  Look around there are magazines you can buy in any news shop like "High Times" that tells you exactly how to grow it and what are the best kinds, etc.

  13. Because IP addresses and Yahoo accounts are a pain to trace to their owner's real address, especially across state lines due to all the warrants and paperwork involved.
