How could somebody with a clear concious defend a man....?

from the death penalty who raped a little boy infront of his sister and video taped it then **** the little boy in the head? i saw the story on cnn somewhere and it literally made me sick to my stomach and i had to go give my son a hug and tell him i loved him.

i believe that man deserves a bullet in the head no questions asked.

why are we wasting tax dollars on a trial for such a horrible animal?

  1. 1:  How do you know he's guilty without a trial?  The fact that somebody's accused of an offence doesn't mean that we should automatically assume he's guilty and impose punishment accordingly.  This is the point of a criminal justice system.

    2:  While I won't debate the merits of capital punishment right now (not that I wouldn't, but it would distract from the core of the answer), clearly there are legal and factual issues to be determined when deciding whether or not to impose the death penalty.  If you think that a class of offences should have a *minimum* penalty of death, then you're welcome to lobby for such a sentencing reform.  I would suggest to you that minimum penalties usually have highly unjust consequences in that they're only relevant when discussing people with significant mitigating circumstances.  However, in the absence of such a minimum penalty, imposing such a sentence would require a fair hearing and judicial determination as to sentence.


  2. Because everyone, including you, has a right to a fair trial. And while you may think it is your tax dollars paying for it, the defendant probably also paid his taxes over the years and is now deserving of equal treatment that you would hope to get.

    And, because this isn't communist Russia.  

  3. Your feelings are exactly the reason we have a Justice System.  It takes the tough decisions about emotional issues out of the hands of emotional people.


  4. That attorney has a clear conscience because we have a Constitution and an adversarial justice system that insists that everyone is entitled to a zealous defense. That is the role that attorney is playing. S/he is not promoting the client's outrageous behavior.

    As much as your present outrage demands "a bullet in the head no questions asked," upon calmer reflection, I'd wager you would not really want to live in a country that does that.

    You can probably rest assured, however, that the justice system will consider the evidence against him, and he will never be a free man again.
