How a payment plan is set for personal injury jury verdict?

Is it based on the income and consider the livelihood of the defendant? Can plaintiff refuse to accept payment plan?

  1. This can be a very complex situation.  However on the bright side most cases are settled before trial and very seldom does any money come out of the policyholders pocket.

    The person who sued can ask for whatever they want, but unless they had very severe injuries I doubt their case is worth 250K.

    A lot depends on if the injured person carried "underinsured motorist coverage. You may be responsible for any payments they make over and above the $25,000 you carry. If that happens you can make monthly payments to the other insurance company. People do it all the time.

    Your insurance company will provide a lawyer to you and you can ask questions about how this play out. I would strongly suggest you ask them about this so you can stay informed.
