  1. First of all, Jailbreaking the iPod Touch is not illegal, you bought it from apple, it is yours, you can do whatever you want with it, whether that means jailbreaking it or using it for an anchor on a toy sailboat (i do not suggest this). The only thing illegal would be to use any copywrited material in an illegal way.  Which brings me to my second point, NES ROMs can also be purchased legally and you can use them on your iPod legally.  I don't know whether you have SSHed into your iPod before or not, but make sure you have downloaded OpenSSH from Cydia before you attempt to do this.  I use a Mac so I'm not too familiar with the PC method, but the fundementals are the same.  Download Winscp  http://winscp.net/eng/index.php

Find your IP address on your iPod, click on the liitle blue arrow beside the wifi network you are connected to.  (this will work only if both your iPod and computer are connected to the same network)  Make sure you are using SFTP in Winscp and if you haven't changed your password yet, (username: root pword: alpine.  from there you can get access to the files on your iPod and put the ROMs in the right place

  2. 1. You shouldn't have Jailbroken it. Let Apple tell you the way to use a PMP. What you're doing is considered illegal.

    2. You can't access files like that. Unless it's an actual app, or just media, then you can't. Sorry.
