How do I apply for a visitor visa for my dad?

Can I go to INS and apply for one on his behalf? Has anyone had experience with this?

he has a felony from over 10 years ago when he use to be a resident of the US, will this effect it? he lost his residency thereafter.

he is in mexico and I want him to visit with us and meet his grandkids... it would be much more expensive for all of us to go there and why we want him to visit.

What do I need to do on his behalf if any? I am a citizen. What should be ready for?

  1. You can't apply for anything.  Your father must apply, himself.  It's up to him to qualify for the visa on his own merit.

    The only thing you can do is send him a letter inviting him to visit you in the USA.  He can take the letter with him to his interview to show the consular officer the reason for his visa request.

    Depending on the type of felony he might have been banned for 10 years, or for life.  He should have been told when they booted him out of the country.


  2. with a felony record and the anti-immigrant environment in the U.S, it's almost impossible for you dad to get any kind of visa. and you can't apply for visa for anyone, even relatives. hope that helps.

  3. As Yak Rider said, your father must be the one who applies for the visa. Before he is issued a visa, he will need to apply for permission to reapply for admission after deportation.

    8 U.S.C. 1326(a) provides for a fine under title 18, or imprisonment for not more than 2 years, or both if a previously deported alien attempts to reenter without prior permission.

    So, he not only needs a visa, he also needs a waiver of the grounds of inadmissibility and prior permission to enter the U.S. before he can apply for admission to the U.S.
