How do I deal with bankruptcy if I am separated?

I recently separated from my wife. We are under Chapter 13 bankruptcy but all the money is being taken out of my check! How should I deal with this situation?

  1. You need to contact an attorney asap!  Did you have an attorney for the BK.  You might qualify to revert to Chapter 7.


  2. I would have waited until you divorced, to file bankruptcy. Because now- doing it this way- you are tangled up in this with her. That sucks.

  3. In the eyes of the law your still married. There is nothing you can do until you get a divorce.

  4. Consult your bankruptcy lawyer and the court. She is responsible also.

  5. Just been through that with my husband.Yes we are still married and he wanted to file bankruptcy.The lawyer said for to file under his  name only he will be responsible for the payment and it might and might not come up on my credit report if it does it will say that I was associated with someone who claimed bankruptcy.So far so good the payment comes to him not me...
