Question:

How do I divorce my wife who lied to me and will be going to prision for a 3rd degree felony theft?

My wife got probation for this and must pay restitution or go to prison. She told me she was innocent, but I found out she lied to me. I can't be with someone who lied to about this. If she does not pay restituion she goes to jail. I want out of this relationship. I want custody of the kids. What can I do?

  2. I don't think you will have any problems getting a divorce if this is the case.

  3. file Pro Se while she is in jail.she will be unabel to protest it while in jail and you win

  4. Let her go to prison for her crime she needs to pay for that and not have you pay for it.  Go to a lawyer and start the divorce papers so the children don't get to involved with this behavior.  

  5. Be understanding. Maybe she has depression or some other stressor that caused this behavior. I assume she wasn't a thief when you married her. If not then try to find the underlying cause of the behavior and this ONE TIME pay her restitution and fines and get her out from under this.

    Your kids should not have to live without their mother. Don't force them to.

  7. When she goes to jail, file a petition for termination of parental rights.

  8. Get a lawyer and if your background is good, along with income, sock it to her.  I'm a woman by the way, but can't take a liar.  Once a liar, always......
