How do I find out if my child's dad gets VA of SS disability benefits & if she should get it to? ?

My daughter only receives $50/week in child support and she is in high school now. I am petitioning the court right now for an increase. I believe her father, a disabled vet, has been receiving a check from the military and maybe a disability check from the state as well. How do I confirm that he is getting these benefits and if our daughter is entitled to the same.

  1. If your child's father gets VA or SS benefits, your daughter is entitled to something also.  Basically, they send a check, supposedly to your daughter.

    Both should be public, so you should be able to get both pieces of information, but if you can't, bet an attorney to get a discovery thing.

Your daughter isn't entitled to anything more in child support than what the court decides.  If your ex is getting disability, it is supposed to be for him to live on since he has some condition or service connected injury that makes it impossible to work at a regular job.    Likewise any VA hospital benefit is for his use and not your child's.  The only pay that you would be allowed to tap into would be if he is getting a military retirement check and out of it should be coming your child's support.  I really doubt, since he is a disabled vet, that he makes enough for your child to have more than what has already been set.  Most of the disabled vets I know are living near the poverty level and barely are making ends meet for themselves, let alone divorce settlements and child support.
