How do I find out if "time on the street (parole)" counts as time served toward a sentence?

I need to find out if the time a parolee has been out on parole counts toward his actual sentence. We live in Kentucky, he's been on parole for 3yrs and hasn't had any other offenses until, recently he got a misdemeanor charge and when he went to report to his parole officer this month they arrested him because it was a violation of his parole. Now I'm trying to find out what info I can to help him. Someone told me that the time he has served on parole will count as time served on his sentence and that it was a new law, just passed this March, but I do not have a clue where to start looking for this type of info. So anyone got any ideas??

  1. Parole isn't time served...He should have been given a sentence the first time he was charged;let's say 5 yrs.Then he got out in 2 yrs..If he gets caught violating parole he will go back and serve the remaining 3 yrs,plus whatever time he gets for the other charge...


  2. Laws vary in different states. Depends on which state you are in. I'm from Tennessee and down here the time that you do the first day you get locked up til the day you get out counts. Then once you are out on parole the time count. Once you catch a charge and the violation is set, your time stops until you are locked up again. (But I believe that this situation goes with all states.) Now I have seen a person get out on parole with a 3 year sentence with only 1yr. 6mos left and violated and turned around and had to do the year and a half, which made none of the time he did on parole count. (but he caught a Federal charge) So I would say that the person that you are talking about will only have to do the rest of the time he have left and won't have to back up and do the time he did on parole. You can start by talking to his P.O. and the Judge on his case.  Hope this helps>>>>
