I posted a week back about a loan I got with a partner. I am the primary but it was on our DBA on which she is the primary. She is also a signer on the loan but not a co-applicant. She sent me text messages to my phone saying she didn't know the loan was going into default and promised to pay and she hasn't yet. I have called her and written her and she isn't responding so I want to take her to small claims court. She lives in Houston I live in Longview. Where should I file my claim?

  1. Where you live doesn't matter.

You file in the county you were in when you signed for the loan.

  2. YOU want to file a claim against her for not paying a loan where you are the primary borrower?  And your damages (caused by her, not by you) are.... ??

You have no claim against her.  The lender does, since you defaulted.
