How do I get Midland Credit Management to stop reporting to the credit agencies?

I have had problems with this company for years now. The debt is past sol and also past ability to report (it is at 8 years old now) and yet Midland Credit Management keeps reporting to the credit agencies. In the past three years of dealing with them they have NEVER validated and when i dispute with the credit report they mark it as disputed by consumer then a few months later Midland shows up again with another account number a new balance but the old one is never removed because they do not respond to the credit report. I still have no idea what they are trying to collect for except for a credit card I had in the early 90's that is long since removed. I now have them listed 6 times all of which are listed as disputed by me but they are claiming to be in pre-litigation which they are not. How can I get them to go away and get the heck off my credit report? I have had no credit cards for 8 years and should have nothing on my credit report but they just wont leave.

  1. If you have kept records and sent things CMRRR, then its time to step it up and file complaints against Midland with the BBB, the FTC, your Attorney General and more importantly, Midland's Attorney General

    You also need to file a complaint against each credit bureau with the FTC, then send another dispute to the bureaus and include a copy of your FTC complaint against them. The basis of your dispute shouldn't be that it could be your acct but that you haven't had a credit card in 8+ years, yet the credit bureaus are still allowing Midland to reage the account and report it.

    If that fails, and you can prove damages (denied credit, higher rates for loans etc...) then sue em all! Not only would you likely have violations of the FDCPA and FCRA to sue for, but you probably have further protection at the state level.

    You can try visiting NACA.net and finding one of their lawyers in your area. Alot of times they will take these cases on a contingency or at least give you some advice in dealing with this.

    If you haven't kept good records AND sent things CMRRR, then you should send one last letter to Midland demanding validation and reference the other attempts .. by saying in my previous attempts on xx/xx/xxxx, xx/xx/xxxx and xx/xx/xxxx I have requested validation which you chose to ignore, yet you continue to verify these alleged accounts with (credit bureau's name). That way you would have proof of at least one attempt, and you would be setting it up to prove your past attempts. Of course, you want to send this letter CMRRR.
