How do I get a company like Sydney Finacial Group to honor their promise to refund my money?

I signed up with the Sydney Financial Group and paid them $3500 by credit card with the express promise that if they could not get me a HELOC, they would return my money. They couldn't and now they say they don't give refunds. They also will not return my phone calls or emails. Or if I do get through to someone, I get the runaround and am promised a return call that never comes. Not only am I out $3500 at this point, but I am paying interset on the money too. It seems like a clear case of fraud to me. Do I have any recourse?
