How do I get an iep?

we just moved to n.c. and my 5 yr old son is in speech, but the teacher says he needs an iep this week or he's out. He's homeschooled.

  1. Call you local school system's director of special education tomorrow and tell them your situation.  If it's a major school system, ask for the person who works with homeschool students.  If all you get is voicemail, call your son's assigned school.  Talk/leave messages for the principal (or assistant principal in charge of the Exceptional Children's Department) and the Exceptional Children's Department chair.  

    If you don't get an answer within by the end of Wednesday, take letters requesting an evaluation for special education.  The school system has 90 days to complete it.  

    Edit:  Yes his time has expired on an emergency placement.  I don't know why they didn't complete the evaluation already.  The local school is deemed responsible, but you may get the ball rolling more quickly by contacting the county office staff.  He will likely loose a couple of weeks of classes.  Ask if there is way this time could be made up.  If not, ask them to include that in writing even if you write that on the forms.

  2. Ask the teacher, or contact the school. They'll know. Thats rough! She shouldn't say hes out because of speech, why can't she help him out?

  3. This is unusual, usually public schools don't help homeschooled children with special ed servcies. This is what an IEP is 'individual education plan' .  It is being in special ed.

    If he doesn't have an IEP plan, how was he getting speech services before??

    In order to get speech services thru public schools the child has to be in special ed.

    You can't get an IEP plan in a week. I Don't know why the teacher said that.

    The way to get it all started is to write a letter to your district special ed director requesting 'an initial full educational evaluation testing in all areas of suspected disabilities to determine if my child can qualify for special ed services as specified by IDEA law'.

    The school will have 60 days (sometimes 45) from the date of your letter to have the evaluation completed and hold an IEP eligibiity meeting to determine if child can qualify to have an IEP plan.

  4. what?  who is providing him service?  the school or an outside agency?  how did he get the speech service in the first place.  If it's a matter of getting records, you can request they be sent from his previous service provider to your new service provider.  They should be able to fax this if you get a release of records.
