How do I get my daughter's biological father to sign off rights?

He has never had anything to do with her, he doesn't pay child support. My daughter just turned eight years old and my fiance is wanting to adopt her. How do I go about this?

  1. Make a deal with him, tell him to give up his parental rights or you will go after him for back child support. In which these days, you can be arrested for.

You and your new husband will have to be married minimum one year before you can start the proceedings.  You will have to contact an adoption attorney, in Michigan it is a flat $500 fee.  Parental rights cannot be terminated by one parent unless there is a replacement/adoptive parent ready.  Well, probably can, but it would be very difficult and expensive.  This way is relatively easy.  The attorney will have to attempt to contact the biodad, but he will know what to do.  Just go on with your life for now.  At about your six month anniversary, start contacting adoption attorneys.

  4. Tell him to start paying child support or you will report him to the child support enforcement agency or he can terminate his rights himself.

  5. Get a family law attorney to draft the paperwork for him to sign waiving all custodial and parental rights.  If he's smart he'll do it and be gone for good. (If the judge agrees and signs off on it.)

    Your fiance can't do anything about an adoption until that's done, you're actually married, and it will be a good year in most jurisdictions for all of that to proceed through court.
