How do I go about claiming bankruptcy? ?

I own nothing, do not have a savings account, rent an apartment, and have a couple payments left on a car that is pretty beat up. I have a ton of cc debt and college loans and am basically living month to month with no assets. I think this is my best option but have no idea what the consequences will be or how to go about doing this? Can anyone give me some info?

  1. You would need to contact a bankruptcy attorney in your area, most will see you on a free consultation. They'll want to see your last 6 months of pay stubs, assets, list of debts and last 4 years of taxes. After reviewing all the information they can tell you what you qualify for. Student loans are not dischargeable in a bankruptcy filing. The bankruptcy filing stays on your credit report for 10 years, the debts for 7 years. The attorney will be able to tell you what you can do. Good Luck!


  2. see an atty. The CC debt is possibly discharge but student loans are seldom going to get discharged. As for the car, you can reaffirm on the debt and pay it off as you need transportation
