I don't want to have to appear in court, because I work full time, and I'm a full time student, and I just don't have enough time to drive forty miles to the county where the ticket was issued for a court hearing. I called FCC, and they told me to send them a copy of my driving record, which is absolutely clean, and has been my entire life.

  1. If you want to contest a ticket, you must show up for a hearing.  If you are unwilling or unable to show up for a hearing, then you must pay the ticket and deal with it.  You can always request they change the date of the appeal which most courts will do if it is requested in a timely manner. And you asked the question, don't get mad when you hear answers you don't like.

  2. You will have to do prior to your court date is talk to the prosecuting attorney for that county or you will have to go to court on that date.

Your driving record may or may not work but you can try. Most likely you'll get it reduced to defective equipment and pay a fine anyway. Thing is most likely you wont be able to talk to the PA over the phone so your kinda in a pickle. You could hire an attorney and he/she would take care of it and you wouldn't have to appear just pay them and the fine for the ticket.

    Good luck!

  3. Your past driving record does not prove that you didn't speed this time.   The Fine Collection Center does not have the ability to dismiss your case.  Only a judge can do that.

If you pay the fine as "bail" and then you don't go to the hearing, you will be found guilty of the charge and the "bail" will be applied to your fine.

You cannot appeal a case if you don't go to the hearing in the first place.

The only way to fight the ticket is to go to the hearing.

EDIT - in your original question, you did not say that your driving record would be sent to a judge.  As I stated, only a judge can decide your case.  If they are willing to do that without you going to court, then great.

You don't have to be rude to people who are trying to help you with the limited information you give.  If you know the answer already, or can get it from the FCC, why come here and insult us?

  4. just send in a check for however much your ticket was for. There is no reason to appeal unless you fell that you did nothing wrong. If you pay the ticket before the Court date then you should have no worries. but if you dont pay by the court date then youll probably have to pay more to get it taken care of.
