How do I handle this situation w/ my renter?

I own a home and rent out two of the bedrooms. They are on a contract til end of August, after which it's month to month. One of the girls is nice but can barely afford to live here (has to split up her rent payments, which annoys me) and she told me she's moving in with her friend at the end of Aug. So, I told my sister she could move in (not a for sure thing yet). The other day my tenant said she decided to stay. I didn't tell her I already filled her spot, because I haven't, but I really was hoping she'd move out.

How can I tell her I am not renewing her after Aug? Is it too late because I didn't tell her I already filled her spot? I don't want to cause problems the last month she is here and her boyfriend scares me.

(Renter's laws in my state say I have to give 30 days notice if i am not renewing her contract, so I have a couple weeks to tell her.)

  1. I would tell her you already filled it, this way this no option, just tell her someone else has already signed a lease.

    To me that is a better excuse that telling her you just don't like her rent payments and her credit it sketchy.


  2. send the 30-day... if they are kicked out, now are they going to know "you have someone lined up"... your home, you make the rules... I have seen countless landlords, taken advantage because they did not stay firm with the rules...

    For future sake... please get a longer lease... why have the headache of month to month... get at least 6 to 12 months...  

    Here is a tip when you show your rooms...

    1st one - when you walk these would be tenants into your home... YOU take off your shoes and casually keep going... see if these people will follow...

    2nd - payments should not be a problem but if it is - give them incentive to have automatic withdrawal - tell them if you set up an auto withdrawal, you get an additional $20-$50 ("your mark up")

  3. Be sure you give here a full 30 days notice. You don't have to have a reason.

  4. Just give her the 30 days notice.  Make sure the letter you send her is legally correct (google for a 30 day notice for your state).  

    When you give/ send her the letter it may not be a bad idea to tell her verbally you have to give her notice since you already filled the spot, even though you only sorta did (you could also include this in the letter but again make sure the letter is correct according to what your state laws say needs to be in there) and have someone else already moving in at the end of Aug.  Maybe say you had someone thinking about it and were not sure it would be filled when you talked earlier - or something like that, anyhow rehearse out the exact story in advance.  By saying you have already gotten a new tenant (when you thought she was leaving), she hopefully won't take it so personally.  

    Of course its not to late, you can just give her 30 days notice for whatever reason (like she can barely pay her rent) but be as nice about the whole thing as you can.  By the way, her boyfriend scaring you is another excellent reason to get rid of her, but don't tell her that.

  5. tell her u thought she was moving and someone else is going to be moving in...that way there are no hard feelings and no problems should arise...if they do it is UR house and since u rent rooms and NOT the whole house the renters law maynot apply to u...call a real estate attorney to be sure.
