How do I make a legal claim for money owed on an estate of someone recently deceased?

A guy I was working for just passed away, leaving an outstanding debt to me. I have the check but cannot cash it. What should I do?

  1. Why can't you cash it?


  2. Contact an estate attorney. That is your best bet, it also helps hedge against the risk of someone else making a claim agaisnt the money, if it's not in a will, trust, or life insurance policy.

  3. Notice is published in a newspaper of general circulation in the area where the deceased lives. It is designed to inform the general population in that area of the death so that creditors and heirs can make a claim to anything they are due.
