I'm getting divorced now and my soon-to-be ex-husband can't pay for the house that he bought during our civil marriage - both the house and the mortgage are in his name - how do I protect myself in this case?

  1. When I applied for a Mortgage on my own the year following my Divorce..The house was on my credit..Go to a Lender and do a credit application..if the house shows up on your credit, you can pay around $35.00 to have it removed from your credit..That is what I did.. Any Lender will do it for you..Good Luck!!

  2. You should not be affected by his bank ruptacy if your name is not on any of the documents. This is includes the mortage, any car notes, credit cards etc. If your name is no where to be found, you should be ok. If you are not sure about what has your name or not, talk with him if you don't want to talk to him consult an attorney to make sure you will be protected from all this mess.

  3. Not sure what you mean by "protect myself".  Do you mean protecting your credit, or not loosing the house?  Will you be divorced before or after the bankruptcy takes place?   This could be a complicated situation and I would highly recommend getting legal advice.
