How do I prove I returned a DVD?

I'm concerned that my local video store is going to pursue me for a DVD I know I returned. They issued me with a late notice and I was surprised because I knew I had returned it with another one as they were due at the same time (the other one they have a record of me returning, but interestingly it shows up as being returned 2 days after I actually returned it - suggests their systems are not up to scratch).

I have gone to the video store and helped them look for it - after a cursory examination, their position seemed to be 'well, it's not here, therefore you are liable'. This seems to be a reversal of what I would have thought would be the burden of proof.

I appreciate this must happen a lot to video stores and it would almost invariably be the customer who has got it wrong - and they therefore have to have faith in their systems - but since I know I returned it frankly I feel affronted that I am being asked to pay for their mistake. Anyone know the legal situation?

  1. I've had this problem also, relating to a bunch of videos supposedly returned late, when they were returned on time.

    First I heard of it was from a debt collection agency though.

    Firstly, I'd call and ask to speak to the manager directly. Explain the situation, and that you (hopefully) have a good record of returning DVDs, and returning them on time.

    It's good to acknowledge (as you have) that you understand the situation that they're in, and that they need to ensure that are DVDs are returned on time, however you know that both DVDs were returned at the same time. You can say that you are concerned about this issue, however you would like them (not you... it's not your job!) to search again for the DVDs. Do you remember the staff member on duty when you returned the videos?

    If nothing else, you can choose not to return to the video store. Most stores don't go out of their way to track down funds for only a small amount of money. But if you don't want to do this, I'd just sound a bit exhasperated. "I just can't understand how this has happened. I'm so careful returning things on time, and I'm just really concerned about the whole process. I understand that you're in a position whereby you need to have all DVDs returned, however I've done so, and so I think that it may be an issue with the scanning in of DVDs at your end. I'd really appreciate it if you went back and had another look, so that we can resolve this issue as soon as possible".

  2. 1) Spread a good word about this shop on terrible these guys are. Let the shop guys know that you would be letting everyone know.

    2) Write a letter to them and tell them that you had already returned to them. make sure it is in writing.

    3) get a lawyer.

    4) inform cops for harressment and extortion.
