How do I recieve my money that I loan some one,?

I payed that person 500 hundred dollars in cash and when it came down to repaying me back he wrote me a check for 500 hundred and when I went to cash the check he didn't have the money to cover the funds... so I talked with him a lil time latter and he said that he canceled that check... and he know I really needed that money just like he did at the time... what shall I doo!!!

  1. Each state is different, so I'll speak in general terms.

    Send him a letter certified mail, return receipt, with a demand letter for the amount of the check + the fee your bank hit you + the cost of the letter and give him 14 days to repay in full.

    State in the letter that you will both file a small claims case (you WILL win) and also file charges with the DA (writing a bad check is illegal)

  2. First of all, never loan anyone money without having them sign a note saying exactly when they will repay it. Then you can take them to small claims court and get your money back.

    There is a saying "You loan a friend money, but an enemy repays it."

  3. Keep the check he wrote you as evidence that in fact he does owe you, then take him to small claims ct.
