Hello, I am visiting the USA for a month. When I enter immigration gave me 6 months to stay. Next weekend I am going to Mexico for a trip, but just for 4 days. I am going in car to cross the border thru San Diego. My question is, Do I have to give my I-94 before I get out, and will they give me another one when I enter??? Or if not what should I do???

  1. The term "meaningful departure" does not apply to nonimmigrants, only returning residents.

You should keep your I-94 in your passport. The Mexicans will not collect it if you cross the land border.

Read the reverse side of the I-94. It will tell you when you're supposed to surrender it. You don't have to surrender it going into Mexico for a four day trip.

Chances are very strong that you will be allowed to keep it for the balance of your stay upon your return.

You don't need a replacement so there's no sense in turning it in and then getting another. A new one would cost you $6.

  2. You will keep your I-94. Since you have not made a 'meaningful departure' during your vacation you will re-enter with the same I-94 with the balance of your time remaining.

If you read the back of the I--94 it will say you must return it when you are crossing into Mexico, however, so long as your stay is less than 30 days you may keep it and be readmitted for the balance of your time remaining...

  3. if 6 months is up you need further permission
