How do I resolve this ebay scam ?

*I bought an MP3 off of eBay

*I paid $84.00 for an MP3 that runs for $100

*They claimed it to be in great cosmetic condition and perfect working condition.

*When I recieved it, it was broken

*We sent it back to get a refund. Shipping cost us $26

*But now they are notifying us that we "switched the MP3 player with another broken one" and they will give us a refund when we give them the "original MP3"

*BUT WE DIDN'T SWITCH THE MP3'S IN THE FIRST PLACE...THEY SENT ME A BROKEN MP3!

So how do I go about handling this?

  1. I do not think you can.  That's one of the risks of buying on eBay.  The only thing you can do is give them a bad review, describe the situation and hopefully it will result in loss of business for them.  This is a he said/she said situation, and unfortunately it goes both ways--many eBay sellers get stiffed too.  I think they do offer some kind of insurance againt this type of thing, but at additional cost.


  2. Did you use Paypal, if so you can plea with them. But there isn't much you can do.

    Take out your frustration through negative feedback so other buyers don't get burned too.

  3. Go into your ebay account and report the seller.  There  are steps to solving disputes. Go into the customer service section and email them. Tell them you want to report product received as broken or not as described.  Go into the seller's storefront.  See if you can mark it as receiving broke.  Do you have paypal?  Report this to them.  There is something on ebay called buyer protection.  Look into this and make a report.  If you bought this on ebay express, there is supposed to be buyer protection on it.  Was the package insured?  If broken, you could have reported it to the post office or UPS.  Don' t give up.  Keep at it.
