  1. Getting a trademark is more valuable than just getting to put the encircled R next to a name. If you register the name, you will be able to prevent someone from using the name in a similar product. The R may prevent most competitors from using the name but you may have to enforce it.

    The first thing you should do is search the name you want to trademark at the USPTO link below. Then hit SEARCH. You will want to find out if someone already has the mark you want. Keep in mind that a name is associated with certain goods or services. For example, a name registered for a car is not likely to be a problem for a sports item.

    You can file a trademark application yourself on the USPTO website. It can be a bit confusing the first time. Nolo Press published guides on Patents and Trademarks. http://www.nolo.com/.


  2. Well, you don't actually have to register it unless you want to use that little "R" in a circle after the trademark.  If you do, then the site below gives you the form and instructions.
