  1. When I were growing up I always went to the bathroom affidavit! (after David! rofl) sorry..you just used it though

I asked my lawyer to apply for an affidavit?

  2. Well...an affidavit is a sworn written statement.  It's used when a person can't be there in person to bear witness to something.  Therefore, you'd want to substitue "an affidavit" wherever you'd use the phrase 'sworn written statement.'

    For example:

Since the witness could not appear in person, he sent "a sworn written statement" of his testimony.

Since the witness could not appear in person, he sent an affidavit of his testimony.

Some judges require the physical presence of a witness instead of just his "sworn written statement."    (You do the substitution.)
