How do I verify an adoption of my kid went through?

Basic synopsis: Back in January 2006, my daughter's mom asked me to sign over my parental rights so that her new husband could adopt our child. I agreed to it only because I did not want to drag my daughter through years of court battles to lose in the end anyway. The mother had been denying my visitation rights for a couple years before that and I had no way of proving it. She was threatening to bring the courts in and say that I had abandoned seeing my child if I did not agree to it.

So basically, my question is how do I in California find out if my daughter's adoption went through? If it did not, is there a way tog et my paternal rights back? If it did, am I still going to have to pay child support?

  1. Good Lord, if your rights have been terminated, you no longer pay child support.  Get an attorney involved ASAP.


  2. Did you ever sign any paperwork to terminate your parental rights? Check with the courts. If your rights were terminated, you will not have to pay child support. However, if they were not, your daughter's mother could ask for back-pay child support. If you find out your parental rights were not terminated, I would advise you contact an attorney who specializes in family affairs.

    I would also like to throw my opinion in. My biological father terminated his parental right because he didn't want to pay child support. He then married a woman with 2 children around the same age as me. He was their dad, but he walked out on me. When he wanted to see me, I metaphorically spit in his face the same way he did to me when I was just a baby. The right thing isn't always easy, and easy things aren't always right.

  3. request her birth certificate. the one with your name on it. if her adoption went through, they won't give it to you because its sealed.

    no to the child support if the adoption went through. And as far as I know once you sign your rights away, your rights are gone unless you revoke them in the 30 days ( i think ) california gives for parents to revoke their rights. I could totally be wrong on that length of time i'm not up to date on my revoke laws for our state.

  4. Go to the courthouse in your area and they can tell you where you can find adoption records.  If the adoption didn't go through then you call the county mediation office and make an appointment.  They will require that you both go to parenting classes and then try to work out a visitation schedule with you.  If you can't come to an agreement then you will have to go to court.  You will have to pay child support unless the child was adopted whether you see or not.
