How do i divorce my husband in texas?

i've been with this man from houston texas for about 6 years now, been married a little more than a year. I am not american. last year my father passed away and my mother got ill because of it, so I came back to my home country leaving my husband in houston. he supported my decision. but, after a couple of months he started to have an affair with this unwelcome woman. and it is him who told me about it so no doubt.he admits he did.

we tried to work it out first, but i don't trust him anymore and we both want a divorce. we have no kids, no assets.

so here's my question, how can i get a divorce in texas without me having to go over there? is it possible at all?? my country is 13hr away from texas on plane so i don't wanna have to go.

can anyone please help me!!

  1. If he is in complete agreement about the divorce and all property issues, you can sign waivers of service and waiver of appearance, and he can handle everything in Texas. He can find the forms at the local library. Look for a book on do it yourself divorce. It will work best if the two of you can say you have already divided all the property and each is to keep what they have at the time the divorce is granted. You can do that with real estate, too, if one of you signs a Quit Claim Deed. He can get that form by going to the District Clerk and buying a copy of one someone else filed and changing the information.

    If there are children or complex property, you can still do it, but you need a lawyer to help. But, no. You can do it without coming to Texas.  


  2. no you have to be there in order to get a divorce, If he files the paper then you can sign an affidavid that says you do not want to be at court. let him fax the paper to you and with in 60 days you can be divorced.
