Question:

How do i file to have full custody our divorce has been final since 2000 with joint custody in oregon?

We currently share joint custody. The kids, ages 11 and 13 go to his house on the weekends. We have no set parenting time. I pay for everything since he has no real home(he has a small travel trailer at a friends house) or job(unemployed last 3 years). My reason for wanting to re- file for full custody is that I am the only person truely taking care of anything. I am not seeking child support as that would be like trying to get blood from a turnip. I just want to gaurentee that I will be the final say in their lives on matters that count.

  1. You do not give much info here, but contact your attorney for advice.  that is going to be a very uphill battle as courts do not like to see children taken away from their parents.  perhaps you have compelling reasons that you do not want to disclose here, but it better very very very bad for a person to lose their visitation with their children


  2. You have to hire another lawyer or the same one you had. Go back to court and show cause to get full custody. I hope this is of some help to you. Good Luck.

  3. You have to file, (in the county you now reside in) a petition for sole /full custody. Of course there will be filing fees, attorneys fees, (if you need one), court costs, etc. What a lot of people don'tt know is that right there at the counter you are submitting your petition at, you can also file a petition for a waiver of payment. You have to fill out an affidavit of income and probably a couple of other forms, but you usually get excepted or denied within a few min.Don't know if you needed that info or not, but just in case. After you file your request for full custody, a court date will be set. He will receive a copy of your petition and an 'answer form' that is due sometime before the court date. Both of you are suppose to appear on that date and argue your sides to the court. It can go either way depending. Well, best of luck.
