  1. It is not up to you to look up this information. It is up to the collection agency to prove to you that they are licensed to collect in your state. This all comes out when you send them a debt validation letter.

    I mean, the choice is pretty simple:

    1. Spend hours researching the .gov websites trying to find this out yourself,

    or

    2. Sending a boilerplate debt validation letter certified mail-return receipt requested and making them do the work instead.

    1. The questioner asked about a collection agency. The FDCPA applies to collection agencies. The questioner mentioned nothing about original creditors.

    2. A collection agency must be licensed to collect within your state if they are pursuing your debt. Your state's provisions may be combined with the following provision from the FDCPA:

    § 1692 e(5) Threaten to take any action that cannot legally be taken or that is not intended to be taken

    If they are not licensed to collect in your state, then they cannot continue attempting to collect on the debt so long as you reside in your state without violating the FDCPA. That will come out when you validate the debt.


  2. Go to your states web site for the Secretary of State and see if they have a link to licensed businesses.  Or you can try your State Attorney Generals Office.

    It will take some time but you can find it after clicking a few links
