How do i get a title for a motorcycle that was financed but the owner filed bankruptcy.

well this is a suzuki motorcycle and the person had it financed. Well the individual filed bankruptcy and his lawyer told him the bank would come get it and they never did and its been 2 years now just need to get title on it and sell it if that is possible

  1. The bank still owns the bike and has the title, even if they don't have the bike. It had to be declared in the bankruptcy filing. You are in possession of someone else's property. You cannot get another title.


  2. Actually, you cannot to both things that you want. As the original owner never completely paid off the bike, he still owes a debt on the cycle.  If you purchased the bike from him, or he gave it to you, the bank that financed the bike still owns the vehicle & has the title.  The bankruptcy becomes a bit of a situation, but for the bank, not for yourself.  The only way you can get the title is to contact the bank that financed the bike in the first place & either pay them in full or finance the remainder of the balance & make payments.  Other than that, it is still a repossable item & if you try to register it or get pulled over by Highway Patrol, you could lose the bike & incur penalties that are not your fault.  If you knew about the bankruptcy & the repo situation from the gate, then you can be considered an accessory after the fact.  If not, you could sue the original owner for fraud.  Either way, if you really want to settle this, contact the bank & see what they want to do/are willing to do.  The two years has nothing to do with it, there is no statute of limitations on repossessing a vehicle.  Also, I would take a moment to check with DMV to make sure that it hasn't been reported stolen.. Better safe, than bling-blinging some titanium-steel handcuffs, y'know?  Good luck..
