How do i get my hazardous material endorsement back being a ex-felon?

for 7yrs i've held a class A license with hazardous material endorsement but after 9/11 once i had to renew my license i was'nt allowed to retain my hazardous material endorsement after paying the required fee and passing the test that's required.the transportation safety admin. say my pass record prohibits me from having this endorsement.but the law states that after 5yrs.after release or conviction my record should'nt hold me back from obtaining this endorsement.

  1. wow. the background requirements were designed to keep terrorists from getting a hazmat endorsement, not to punish poor schmucks like you and I from being able to put food on the table. kinda makes you think about where this government's priorities are.

    These are the disqualifying offenses for a Hazardous Materials Endorsement:

    Unlawful entry into a seaport

    Assault with intent to murder

    Kidnapping or hostage taking

    Rape or aggravated sexual abuse

    Unlawful possession, use, sale, manufacture, purchase, distribution, receipt, transfer, shipping, transporting, delivery, import, export of, or dealing in a firearm or other weapon

    Extortion

    Dishonesty, fraud, or misrepresentation, including identity fraud

    Bribery

    Smuggling

    Immigration violations

    Violations of the Racketeer Influenced and Corrupt Organizations Act (RICO) under 18 U.S.C. 1961, or a comparable State law, other than any permanent disqualifying offenses

    Robbery

    Distribution of, intent to distribute, or importation of a controlled substance

    Arson

    Conspiracy or attempt to commit any of these crimes

    Permanent Criminal Disqualifiers

    You are permanently disqualified from holding an HME on a state-issued CDL if convicted or found not guilty by reason of insanity for any of the following crimes:

    Not Eligible for Waiver

    Espionage

    Sedition

    Treason

    A crime listed in 18 U.S.C. Chapter 113B - Terrorism, or a State law that is comparable

    May Be Eligible for Waiver/Appeal

    Bomb threats

    Crime involving a transportation security incident

    Improper transportation of a hazardous material under 49 U.S.C. 5124 or a comparable State law

    Conspiracy or attempt to commit any of these crimes


  2. you can get a lawer and talk to him he can file for a expungment ????   a judge will look over your records make to make sure your not a hardend criminal and that your felony was just a freak one time deal and possibly grant it to you
