How do i get my stolen car back ?

my mother was looking around for a car for me because back in aug. my car was stolen.(it was givin to me as a gift from her and my dad) she went to a dealership and found the car all fix up and ready to sale now the insurance company paid her for the car last year we reported it stolen and everything they say the car is a year less than what it is and want way to much for it what can we do to get it back because i have been with out a car since aug and i need my car bad.

  1. I understand you may want the car back because your parents gave it to you.  I'm sure your Mom would have to pay back the money she got from the insurance company.  Then prove that the car is yours. Do you have the VIN#?. This would all involve contacting the police, they would impound the car if the VIN#'s match. A lot of paperwork. Dealing with any governmental office is a slow process.

    If it's not a sentimental attachment, it may not be worth the trouble.

If isn't your car.  When the insurance company paid her, they bought the rights to the car.  If it was then recovered, they had the re-sale right to the car.  If you want it back, you now have to buy it from the legal owner, the dealership.  The insurance company can't sell it to you, they no longer own it.

    As far as the age of the car goes, it is right in the VIN#.

    The police won't get involved, as it is no longer a stolen vehicle, and did I mention, it isn't yours!!!

  3. If the insurance company paid you for the car, then you no longer own it.

    End of story.

  4. You can't get it back.  When the insurance company gave you that check and you ACCEPTED said check, the insurance company effectively bought the car.  So it was theirs to do with as they pleased, if it was recovered.

    As to finding the same car at a dealership, you'll have to prove, via CARFAX, that the car is in fact older than they claim.  Armed with that and a very nice attitude, they may cut you a deal.

    But I doubt it.
