How do i get my visa status back?

I live in USA. My father work for the embassy. My visa type was G1 and it expired 2 years when my dad came back to my country. I did not change it to F1 ( i am a student). Now my dad is coming back to work in the US again. Is there any way i can get my visa status back.

  1. Sounds like you were out of status for two years.  In all that time, you didn't leave the USA?  If you're still eligible to be your dad's dependent, he can apply for you, but you should expect some hassles for being out of status. And it's possible you'll be permanently excluded. G and A visa holders have some drag, but being out of status is big no-no with Immigration.


  2. two years of living dangerously. Well, if you are eligible to be your father's dependent, and if he's picked up the tab for your education and living expenses, you may well be, you may well be able to acquire a G1 visa again. Not sure if you can do so without leaving, but you can always try. Why you didn't bother to get a student visa when you could have easily enough is an interesting question though.

  3. I really doubt it.. once you have stayed illegally it will be hard to get your visa back, but I think you can go for the resident status..

  4. At the moment, you are out of status. I believe your quickest route back to the G-1 status would be through a departure and a return to the U.S. as a G-1 with a G-1 visa.

    G's are only inadmissible on security grounds, 212(a)(3)(A)(B) & (C), and reasonable documentarty grounds. G-1 dependents are allowed to attend school without an F-1 visa.

    You can get yourself out of the mess you've created by leaving the U.S., getting a new G-1 visa, and coming back in fresh as a newly admitted G-1.

  5. Realistically, you may be residing in the U.S. illegally right now.  As it stands, the U.S. Department of State will be the place to revise your visa status, and I'm including a link below to their Visa section.
