My daughters dad refuses to files taxes. He says his wife has thrown all his papers out and can't get them back. But really the bottom line is he doesn't wnat the money to go to back child support. What do I do to get him to file its been 6 yrs.

  1. have you considered one of the private child support collection agencies shown on tv?  talk to your local human resource centers (where you go to get food stamps) they can point you to a local pro-bono legal help clinic if you have court-ordered child support.  if they take your case he can even go to jail...funny how my ex came up with money he "didn't have" to get out of jail.

  2. You can report him.

However, they are most likely aware of what he's doing and will catch up with him sooner or later.  Just because he's not filing doesn't mean the IRS isn't aware of his income.  They get the information from employers.

  3. call the irs. that what i did

  4. Go back to the courts about not getting child support and let them investigate.

  5. Instead of forcing him to file his taxes (his choice not yours), wouldn't it be easier to petition the courts for him to pay the child support that he owes?

  6. You are up a creek.

If it's obvious that he would get a refund if he filed, the IRS will NOT waste any money making him file.  There's no money in it for the IRS (after 6 years the excess refunds go the national debt) and they don't have an obligation to care about your back child support issue.

You can take him to court and ask the court to hold him in contempt for not filing, but that's it.
