the city is going to tear down my grandmothers tree to make way for a street light that is not necessary.

The city did not give us a notice, so i didn't have time to do anything.

Please give me any advice on how to stop this!

Thank you.

  1. If the tree is in a city owned right of way or easment, they may cut it.  If it is growing into their easement, utilities, or a public hazaed, they may trim it.  If you chose to deal with the problem yourself, consult a qualified arborist or tree service

  2. Get before a magistrate, J.P. or any judge you can ASAP and ask for a temporary order to cease and desist..Good luck...KTnTexas

  3. If the tree is on the other side of the sidewalk next to the curb, than it's not your tree. That is a city owned easement. Basically,  They can do what they want.

Maybe you can chain yourself to it and call the local news.

  4. Well, you can quickly get an attorney to draft a letter but I doubt you can get one before tomorrow.  Have you called your city officials and asked?  Even then, I'm not sure you could stop it but you can try.  Maybe you could replace the tree with a smaller one that wouldn't interfere with the street lamp.  If the tree is an older one, it probably needs to be replaced anyway.  Does it pose a danger to anyone?  Such as, old limbs that need removed or is the tree in danger of falling over in a high wind?  I'm just trying to find reasons they may want to take it down.  I'd call the office responsible for the cutting and see why they are doing it.  If you can't get a reasonable answer, try a legal office or call the local TV station, they may want to publish the "news".

  5. is the tree actually on your private property, if so they cannot trespass per say, if tree is on town property outside your property line, then the tree is not owned, you do have option to transplant  at cost, unless tree is contaminated, if only for a street lamp, sounds odd, although if tree is on top of power lines, then sooner or later it would end up being removed, the lawyer route may be good idea if able, also check with your insurance company about loss or damages, good luck,♥

  6. what you need to do is make people sign a potition saying not to.And in order for them to do that you need to give them a reward like an invitation to a party that you will trow.

  7. contact your local counsellor.and the media make a big show of this imagine the headlines "poor Little granny bullied by city wheel ding chainsaw thugs"get the neighbours together resort to environmental terrorism get some huge Spikes (nails) and spike the tree put warning signs on the tree that it has been spiked no body in there right mind will try to put a chainsaw into a spiked tree even if you don't spike it put signs on the tree that you did this may buy you some time to save the tree.

  8. You should make a potition

or even tie your self & others

    to the tree!

  9. if its on your private property i don't think they can tear it down if that doesn't work try letting people sign something

  10. Eminent Domain - there really is not much you can do.  I am sure this was a decision made during council meetings etc.  Ultimately you are not going to be able to stop it.  The only thing I have ever seen work is going loco - calling the newspaper to tell them you are chaining yourself to the tree.  There will be a press feeding frenzy you just have to be able to establish that the light post can go in somewhere else without killing the tree.  It is a tough sell and HIGHLY unlikely but probably your only hope.  Good Luck!
