How do people get the US government to amend the Constitution?

In your opinion, do you think it'd be possible to get the laws that were changed before changed again?

  1. There are two ways the Constitution may be amended (changed). First, the formal way as stated in the Constitution. Second, by interpretation. The Constitution is interpreted on an almost daily bases. Federal Courts also have the power to interpret the law, the highest of which is the Constitution.

    Article V explains the two formal ways to amend the Constitution. A president does not have to sign an amendment for it to go into effect. The states have the final say as to whether an amendment is added to the Constitution.


  2. It is called an amendment to the constitution.  It takes 2/3 votes of the senate to pass an amendment and the signature of the president.  But before that is takes years of work to get it that far.

    The civil rights amendment took years.

    The amending process for the Constitution requires a 2/3 vote in Congress (not just the Senate) or a constitutional convention by 2/3 of the state legislatures. That is followed by ratification of 3/4 of the states (not the other way around), either by the state legislatures and state referendum.

    Interpretation of the Constitution is the role of the courts, ultimately the Supreme Court.  This is not an amendment to the Constitution, just a different view of the Constitution by the courts.  That is why the Fuller court in Plessy v. Ferguson upheld racial segregation on a "separate but equal basis", but was over turned by the Warren court in Brown v. Board of Education.

  6. Yes it is possible if its wanted.  It requires 3/4 of the states to propose a amendment and 2/3s of congress to ratify it so it can be done in extreme situations.
