Question:

How do wage garnishments work?

I forgot I had a payday loan and was taken to small claims regarding it. Anyways, the lady from the payday loan place did not want to work with me on payments, so I'm assuming they will send the info off to my employer for a garnishment. I only make about 577 on each check, bi weekly, I pay rent (375), other utilities, plus am the only income in my household. I live in Colorado. How much would be taken out of each check and how long before the garnishment's begin? I'm considered low income, but I doubt that would have any affect on the garnishments...

  1. If the court starts garnishment proceedings, they can take up to 25% of your check AFTER taxes.  Yes, it sucks.

However, if it's ruled against you, you can appeal the overall judgment amount, citing your other debts (rent, utilities, etc) and that could drop the judgment amount.

Court costs are also tacked on as well, plus interest.

  2. to answer you question the court can only request up to 25% be taken out so if they take the max you will have a chunk coming out!!!

  3. It goes through your local  County Court and the Sheriffs Department.. They will take a certain amount each week, two weeks or monthly how ever you are paid.. until it is satisfied.. Be advised that if they garnish your wages it has been awarded to them by the courts and will collect court fees as well ... If you can show up to the court date and appeal to the judge that they refused to work with you in paying it back

Personal Experiance went through it with my ex husband
