How do we start adopting?

My husband and I have sort of a unique situation. His 16 month old lives with us and has not seen her bio mom since she was born. She was born addicted as her bio mom was high on crystal meth throughout the prengancy. CPS stated that there is to be NO contact between the two of them whatsoever. I am this little girls mom, in essences, as i've raised her and im the only one she knows.

Now- my husbands exwife (our babys bio mom) has contacted us and expressed a desire to give up her parental rights in exchange for not having to pay childsupport or back child support that is owed. We want this very much but i dont know how to do it.

Once she gives up these rights i'm free to adopt our daughter, correct? how do we go about doing that?

  1. First things first.

    Contact an attorney to help her sign a Voluntary Relinquishment of Parental Rights while she is willing.  ASAP.

    Then you can figure out the rest.  To adopt her, you will have to get an Adoption Homestudy, then once it is approved, go through a hearing to formally adopt her.  But you have plenty of time for that.  I would not worry about that now.  You have years to do that!  But your husband will have custody, so there is no hurry.  

    But get the termination of her parental rights done now, before she changes her mind!

  2. go to probate court for your town and let them know what you want to do.  they will walk you through it.  If she will voluntarily sign away her rights it will be much easier than if you have to file to tpr. this stands for termination of parental rights.

  3. Not all states require a homestudy for a stepparent adoption. I would contact your daughters CPS caseworker to see what the steps are. They should be able to walk you right through it.

  5. I would think you would have to contact child services or family services and a lawyer to have all the proper papers filled out... if it is different then they should be able to tell you who to contact... best wishes for your family....
