How do you break a lease legally?

  1. You negotiate the amount you need to pay to break the lease, if it's not addressed in one of the clauses.


  2. Check the landlord/tenant laws in your state, which you can find in the reference section of your local library.  They will detail the conditions under which a lease can be broken.  Generally the rented area must become unlivable due to health or safety issues, or the landlord must behave in a criminal manner, etc.  You can't just get out of a lease whenever you want to.  The other option is to speak to your landlord and see if he will work with you on letting you out of the lease early.  In either case it will be to your benefit to know the law as it applies to you.

  3. You cannot break a lease just because you want to move!!!  You certainly can leave - but it will cost you your deposit and probably other fees.
