I am aware that you can request and or change your instructor while taking your behind the wheel test, but how? do you formally request when you go to counter 26, or can you wait to see who they give you and then say h**l no?

  1. Why do you want a different examiner?  Did you fail before?  Why did you fail?  You wait in your vehicle in the drive test line.  If your next in line and the same examiner who failed you approaches, you can ask for another.  If you are at a larger office, there are usually 3-5 examiners available.  The majority of employees working in a CA DMV field office are not examiners and only those designated as driving examiners can conduct road tests.  Employees who are not examiners can never conduct the test.  If your at a smaller office there may be only one examiner and you would have to either accept the same examiner or schedule an appointment at another office at a later date.  If you did not fail before, asking for a different examiner basically never happens and you would have to state your reasons.  This would be the same as the examiner walking up to the car and saying h**l no I'm not taking this person out.  DMV wants you to pass and they want safe drivers on the road to protect you and everyone else on the road.   DMV examiners do not arbitrarily fail someone.  If someone is not ready, they will fail with any examiner.  LISTEN to the instruction the examiner gave you at the conclusion of the test and you should pass the next time, even with the same examiner.
