  1. You can't collect support from the other parent's spouse.... it's the parent's responsibility to pay their own child support obligations.  If the parent isn't working then you can't collect, however, arrearages will still accumulate.  They are still obligated to pay support so if your case isn't being managed by child support enforcement, I would urge you to contact your local child support office and get things set up for them to handle your case.  If the parent starts working or needs to be located, they can help you with that.  They will also keep track of arrearages and if he is owed any money (like from state/federal taxes), then they can arrange for his refunds to be taken to pay his child support arrearages.


  2. it wont matter about the spouses income they wont even consider that........job or no job the non custodial parent will still have to pay

  3. File for child support, get your order.  Come tax time, their joint return goes straight to your baby.

    ADD:  You're all wrong people!! You could give me a thumbs down all you want, but I filed for child support a few years ago, he's not working, but this year I got a big check from the IRS.  Their joint return came straight to me.  Don't get mad cuz you married a dead beat!!

    Your child's parent's spouse is NOT responsible for paying child support for the child you two had together.. LMAO!!

    Thats the most ridiculous thing I've heard so far regarding child support!

    And I've heard and experienced a lot--including my husband STILL paying support for his 22 yr old daughter via court order.. not to mention we put her threw college, then university.. oh and did I mention the daughter works as well!! AND YES this order was enforced by a judge!

    So.. sometimes EXTREMELY unfair things/arrangments happen when it comes to child support but I HIGHLY HIGHLY HIGHLY doubt your ex's new partner will somehow be found responsible for and ordered to support for your child..

    It'd be a cold in h**l let me tell you if my hubbys ex tried to pull something like that on me!!
