How do you evict someone from your home who is not on your lease in Maryland?

Ok....boyfriend moved in. He is not on the lease, but the utilities are in his name (it's just one bill, which he doesn't pay, in fact, he doesn't pay ANYTHING). He has keys, he has stuff there. It's only been about 6 weeks. I want him to leave, he won't go. What can I do?

  1. well - first of all if he is not on the lease your landlord can evict BOTH of you.

    Talk to your landlord - see if they will forgive the unauthorized tenant and let you change the locks while he is gone. NOTE: changing the locks without landlord permission is illegal and grounds for eviction.

    He is technicaly tresspassing and can get arrested - but this would typicaly require the cooperation of your landlord.


  2. By law even if they are not on the lease you can order him a 30 day notice to vacate the premises. It is a standard procedure anyone living on someone's property a 30 day notice to vacate is how much notice you are to give. Give it to him and writing (keep yourself a copy) even if he doesn't sign it, wait for 30 days if he still does not leave call the non-emergency police who will come remove him off your premises for you. I have had to do that with my ex boyfriend and that is what I was told to do. If he is crazy and you don't feel comfortable contact your local non-emergency police to see what they can do for you too about ordering him to leave. You can always have your locks changed when he is not there, I have done that too while in this situation later on and had an arrangement for a day for him to get his stuff out with an officer there so he would not go in an outrage. It does not matter which state you are in, this is the proper procedure to do. I hope I helped! Oh, he is just camping there because he thinks you have no back bone which is why he is getting away with this. He's free riding. Verbally explain to him too your plans for him and give it to him in writing. Documentation is important in case he retaliates.

    The police officer will want to see your lease agreement to verify he is not on the lease. Utilities do not count as being a lease holder. You are the lease holder you are in charge. And yes he is trespassing at this point. So call the police.

  3. Call the police.  He is trespassing.  Have the copy of the lease handy.  The police will give a trespass warning.  If he comes back he will be arrested.

    You do not have to wait.  Do change the locks.  If he breaks in - that is a whole different story.  The police can escort him out with his stuff.  You are under no obligation to store someone  Else's personal belongings, or secure them.

    People who put themselves in bad situations - like not having control of their property planned on being in a bad situation.  So don't worry about retaliation - there is no legal basis for you to be responsible for this individual, or is property unless you are married.  If you are married the property belongs to you anyway.
