How do you get birds out of your tree?!?

We have a catalpa tree that hangs over our patio (and pool) and some birds (hundreds) have made it their home and they do their (business) all over the place which is getting out of hand and we would like to know how you would go about getting them to stay away without killing them....we have placed two owls in different places and we DO have a bb gun but dont want to have to use it and we certainly dont want to cut the tree down either....actually that is OUT OF THE QUESTION because it is over a hundred years old and alot of it hangs over the entire house so that cant happen......what else can we do? any advice? PLEASE HELP!

Birds don't like motion..you can try hanging CDs on strings from the tree.  The swaying and swirling of them in the wind may deter them.  Usually the owls only work for a little while..once the birds figure out they are unmoving and always in the same spot..they pretty much figure out they are not any harm to them.  You might put something out that moves...it would be more effective.  Also, you should NOT shoot them with a BB gun... not only will this solve nothing..but it is illegal.  All wild native birds are protected by law...harming or harassing them in any way can get you fined or jailed.  Also make sure there is nothing else on your property attracting them...a water source, pet food left out, etc.  In extreme cases, you can hire a pest control place to put netting on the tree so birds cannot gain access...but it may be quite expensive depending on the size of this tree.

dont hang strips of tin foil, that will only attract them because it is nice and shiny and birds love that sort of stuff, there is nothing you can do without harming the birds, its their home and they dont want to leave it. Maybe you can hang a bird feeder on a different part of your patio so they are attracted there instead of the tree.
