How do you get rid of an executor of an estate

My husband mother passed away a few months ago. She had a will that named (lets call them the devil) the executor of the estate. Now they hate each other. The devil took the car and the jewelry out of the house the day after she died. Wore the jewelry and drove the car to the funeral. Now the devil went to court to probate the will and we were notified however the time was changed and we were not notified. We wanted to have someone else take controle of the estate so no parties have to communicate with each other. The devil lied and said we didnt want to come. What do we do. We dont want the devil to take control. The devil would lie through its teeth to get what it wants. The devil already took money and etc..... we want the devil gone..... Please help

  1. You have three good choices.  Hire an attorney, hire an attorney, or hire an attorney.  I read a lot of questions here on YA and this is almost always the answer.  An attorney can inform you of your rights and file necessary paper work.  

    I know you are looking for some specific advice, but this is a time sensitive issue with thousands of dollars at stake.  Don't risk doing this on your own.  An attorney really can help!

The only way this can be done is to petition the court.  You will need proof of her wrong doings.  You can also attest that she lied in court about your appearance.  You should consult several attorneys before selecting one.  Many attorneys will over charge you for this type of case.  You don't need the most expensive lawyer in town to handle this for you.

  3. Petition for removal.  Get a probate lawyer to help you.


  4. You have got to get an attorney.  The devil is not able to take money, use the car, etc.  His job to to fulfill the wishes of the deceased and make sure her will is executed. He has to be able to account for everything, including the jewerly.  You can't just get rid of him, contact an atty right away.
