How do you get your landlord to sign a early lease termination if reasons for leaving are medical wise?

my son is extremely medically fragile and we receive section 8 to help pay for rent. we live in visalia and he has to make many trips to madera a good 40 mile trip and we don't have transportation. i asked my manager to sign an early lease termination but she refused. how legally do i get her to sign it in the best interest of my son so we live closer to the hospital?

  1. Expert Realtor is correct.

    Since you are Section 8, why don't you call your caseworker and find out if there is any way for them to help.


  2. Call the local housing authority in your area or "HUD" Housing and Urban Development office who is supplying the Section 8 payments each month and explain to them your situation. Ask them if you get a statement from you physician explaining why you must for medical reasons vacate the unit to relocate will that work. Usually a doctor's written explanation will release you from further obligation. That is something you have not control over. Don't even deal with the landlord about it if they are not willing to except the Doctors notice. They may not even know that they have to except it but Hud will. Good luck!

  3. You cannot because the landlord, legally does NOT have to accommodate that request.

    You are expecting the landlord to foot the bill for your son's medical issues...which she doesn't have to do.

    There are expenses involved with re-renting the property.

    Section 8 does not give you special protections in breaking a lease--at all

    No court will make her sign it.  That is YOUR responsibility not hers.

  4. A lease is a legal contract between two parties.  The landlord will have to agree to end it early just as if the landlord wanted to end it yearly you would need to agree.
