Question:

How do you know that you have been served with a restraining order?

I think that my ex had a restraint against me but I am not sure that this is what it is...I am confused because it says that I have to stay away from him...and he is the one who is abusive. I had actually went to file a report against him this morning because he was acting a fool, hitting me and my daughter last night and I just needed to leave...I did speak to a detective, but how do I know that this is a restraining order?

And why would he have one against me when I don't live with him or go anywhere he may be...he's the one always showing up out no where.

Am I just over reacting? Do I just go to court? What do I do?

  1. You have to go to the court in your county and file for a restraining order.. or protection from abuse.. (pretty much same thing), You need to start documenting the things he does to you. They will wnt proof in most cases. Sounds like he filed the claim..and they served you an order.

    Sometimes they order you to stay away on a temporary basis.. if the case is going before a judge. (that's how it workd for me)

    ** it sounds strange b/c he is the abusive one. But abuse is all about control.. So even though you havent done anything to him.. he is trying to control the situation by filing false claims. on you. Girl get out, and stay away from him. DONT GO BACK..

    In my case I was abused by my father.. he responded by filing false reports..which didnt get granted...

    I think the judge already knew!! Here this huge man 5'10 over 200lbs, with abusive history.. and criminal record.. filing a protection order against me.. 5'5 135lbs.. never even been arrested.. honor roll student.. lol.

    I think thats just a standard form they give the victim. A lot of times the girls will file a report.. then go right back around the abuser.. so maybe thats what that is about. SInce you got it so fast.. i would say its probably a petition for a restraining order..its not in effect yet.  They will deliver him something. ..

    if he filed something against you..it wld take longer than a day for you to get it.. so yeah they jst gave you standard forms

  3. Someone gives it to you. There can be a restraining order. but until the court has proof that you have been give it or are aware of it then it has not been "served"

  4. Well if your questioning that paper work I'd suggeset going to the court house or asking someone thats dealt with that before... That would be your best bet.. maybe its just a copy of what they gave the guy that was abusive.. don't hurt to ask questions.

  5. go to a courthouse and ask to confirm your restraining order requirements.

    when i was 15 i had a verbal restraining order against an abusive ex boyfriend of mine and i couldn't talk to him either.

    trust me- you'll know when you fill it out. because it's a lot of signing and initialing.

  6. If the officer brought you the papers, you have been served.  Read the papers to find out what your rights and responsibilities are.

    It is good that you filed a police report for the assault.
